Criminal Defense
Criminal Defense Lawyer in Toledo, Ohio
Toledo, Ohio attorney Charles Boyk offers aggressive criminal defense representation for clients who have been accused of serious
crimes, felonies and misdemeanors, and who face the possibility of a prison sentence and/or hefty fines if they are convicted. We divide our criminal law representation into two areas:
Serious Felonies: Chuck has represented defendants in Ohio facing the most serious criminal charges, including serious felonies such as
arson, rape, voluntary and involuntary manslaughter, v
ehicular manslaughter, kidnapping, assault and battery, car theft and burglary. In many cases, Chuck has helped innocent people preserve their freedom and avoid imprisonment for crimes they didn’t commit. In other cases, Chuck has helped his clients obtain reduced sentences or lesser charges for their convictions, or mount appeals to higher courts for a review of their cases and trials.
Lesser Felonies and Misdemeanors: Chuck has also represented Ohio residents who have been charged with lesser felony and misdemeanor offenses related to
drunk driving, drug possession, drug conspiracy and
drug trafficking charges, as well as
domestic violence and
juvenile law. As an attorney who has worked with families across Ohio, Chuck understands that sometimes even the most law abiding people have unfriendly brushes with the legal system. If you find yourself in a position you never thought you’d be, Chuck will be there with you to ensure that your rights are protected and that every legal advantage of an experienced criminal law attorney comes to your defense.
Cop Pop Culture and Real Life: Not the Same
When we hear or read about crimes, or (more often) see them re-enacted on television and in the movies, we are often lulled into assuming that competence, objectivity, precision and experience are what guide police investigations of crimes. In life, we assume, as on television, the police always uncover the facts of the crime, and they always get the bad guy.
But the meticulous and precise criminal investigations that neatly unfold for us each night on our favorite cop shows bear little resemblance to reality. Police departments across Ohio are frequently overworked, understaffed and underpaid, and lack the technology, budget and leadership to conduct complete criminal investigations. Too often, police investigators are measured and rewarded by the speed and efficacy of their arrests and convictions, and not by the thoroughness or accuracy of their work. Pressured by the prosecutor, the public, politics or even budget cuts for a speedy resolution to a case, police often turn their investigative efforts toward the most obvious suspects, failing to reveal those who are truly guilty of the crime.
In cases where someone is falsely accused of a crime, it is often discovered that the police have overlooked key evidence, omitted evidence in their investigations, or even tampered with evidence to strengthen the case for the prosecution. In other cases, accurate and professional police investigation gives way to
prejudice, stereotyping, racial profiling and other attitudes that are the antithesis of fair play and justice.
Whenever someone is falsely accused and convicted of a crime, justice is doubly injured. The victim of the original crime doesn’t receive retribution for the crime committed against him or her, and an innocent person is punished for crimes he or she didn’t commit. Sadly, despite advances in technology and improved methods of police work and accountability, people are still falsely accused and routinely imprisoned in
Ohio’s criminal justice system.
The Importance of Retaining a Private Attorney for Your Criminal Case
When you are arrested for a crime, you have the right to an attorney. If you cannot afford an attorney, one is appointed to you. These attorneys are known as public defenders. But as well-intentioned as they usually are, even the best public defenders can be too overwhelmed with a backlog of cases to provide someone accused of a serious crime with the level of detailed involvement, representation and advocacy an accused person often needs. Added to the tremendous workload of public defenders is the fact that many of them are young and inexperienced in law. While the experience they gain in public service may one day help them to become skillful trial lawyers, they usually aren’t yet, and the learning curve they face can sometimes cost innocent people their freedom.
At the law offices of Chuck Boyk, we devote substantial time and resources to our
criminal defense cases. Chuck and his team investigate every aspect of the circumstances of your case, including the police investigation, physical and material evidence, and the prosecutor’s case. We depose and cross-examine all relevant witnesses to the crime. Chuck has worked in Ohio law for more than two decades, and knows where breakdowns and missteps most often occur in criminal investigations. Chuck asks the hard and complex questions that need to be asked when someone’s liberty is at stake, and he always make sure he gets the answers.
If you or a loved one in Ohio is in need of experienced legal counsel for a criminal case involving felony charges such as
arson, manslaughter, assault and battery, robbery or
burglary, or if you are facing other criminal charges related to
drunk driving,
possession of marijuana or cocaine, contact the law offices of Charles Boyk today for responsive and experienced legal representation in your criminal case.
